Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the Rock&Roll TimeTable website (the “Service”) operated by Rock&Roll TimeTable (“us”, “we”, “its”, or “our”).

Your access to and/or the use of this Service and its Artwork is conditional on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service and/or its art including the ArtBoardGame.

By accessing or using or searching the Service or its Artwork, you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access nor use the Service nor its Artwork.

These Terms include the Privacy Policy.

Purchases

When you order from us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in consequences, including but not limited to immediate termination of our Service and/or a failure of a transaction.

We need this information to complete your purchase.

All purchases occur in Albuquerque, NM USA.

Intellectual Property

All of the Artworks sold or given away, as well as all parts of this website and the ArtBoardGame are copyright 2018 & 2019 & 2020 & 2021 jeasterling/Jeaster, dba Rock&Roll TimeTable. All rights reserved. The Service, ArtBoardGame and all Artwork, the original content, features, use and functionality are and will remain the exclusive property of Rock&Roll TimeTable, jeasterling, and licensors.

Accepting, using or purchasing any physical Artwork or virtual/digital Artwork, as in ordering or downloading from this site, purchasing NFTs from other markets, or accepting and/or using the ArtBoardBame or any Artwork, means that it is for personal use only.

You agree to submit to the personal jurisdiction of the federal and state courts located in Bernalillo County, New Mexico, USA for any actions; including those for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction, to prevent the actual or threatened infringement, misappropriation or violation of our copyrights, trademarks, trade secrets, patents, or other intellectual property or proprietary rights.

This is a work of art and fiction. Names, characters, businesses, events and incidents are the products of the artists’ imagination. Any resemblance to actual persons, living or dead, or actual events is coincidental.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Rock&Roll TimeTable.

For example, we use third-parties as in Stripe to facilitate purchases.

Rock&Roll TimeTable has no control over, and assumes no responsibility for, the content, privacy policies, nor practices of any third party web sites or services. You acknowledge and agree that Rock&Roll TimeTable shall not be responsible nor liable, directly and/or indirectly, for any damage or loss caused or alleged to be caused by, or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We advise you to read the terms and conditions and privacy policies of third-party web sites or services.

If there is an issue with any link within our website or to a third party, we strongly encourage you to notify us, and allow us to solve any problem.

Termination

All provisions of the Terms, which by their nature should survive termination, shall survive termination; this includes but is not limited to: copyrights, ownership provisions, warranty disclaimers, indemnity and limitations of liability, and jurisdiction of law.

We may terminate or suspend a transaction, your ability to use this site, access to our Service, and/or blacklist any IP address or entity without prior notice or liability, for any reason whatsoever, but especially without limitation, any breach of Terms.

Upon termination, your right to use the Service and its Artwork immediately ceases. If you wish to terminate, you may simply discontinue using the Service and its Artwork. No notification is necessary.

Governing Law

These Terms, all downloads, all Artwork, all transactions, and all use of this site and its Artwork shall be governed by and construed in accordance with the laws of the United States of America and the State of New Mexico.

Use of this website or its Artwork constitutes an agreement to the Terms.

Our failure to enforce any right or provision of these Terms and associated Privacy Policy shall not be considered a waiver of those or any other rights. In the unlikely event that a provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms and the associated Privacy Policy shall remain in effect.

You agree to submit to the personal jurisdiction of the federal and state courts located in Bernalillo County, New Mexico, USA for any actions. All purchases occur in Albuquerque, NM USA.

These Terms, including the associated Privacy Policy, constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we may have between us regarding the Service and its Artwork.

NFT Terms

Thanks for your interest in a blockchain-based non-fungible token (“NFT”) created by Jeaster, dba Rock&Roll TimeTable.

As a recipient of the NFT, either through an initial transfer from Rarible/ Mintable/ Open Sea/ SuperRare or any other market or subsequent transfer or purchase, you agree to these NFT Terms by and between you and Rock&Roll TimeTable (the “Terms”).

The NFT is a limited-edition digital asset created by Jeaster that includes artwork owned or created by Rock&Roll TimeTable (the “Artwork”). The Artwork may also incorporate one or more elements of Rock&Roll TimeTable’s trademarks and branding (the “Brand”).

Although the NFT itself is owned by the recipient of the NFT, the Artwork and Brand associated with the NFT is licensed and not transferred nor sold to such recipient. So long as you comply with these Terms, Rock&Roll TimeTable hereby grants to you, solely for so long as you are the owner of the NFT, a non-exclusive, non-transferable, non-sublicensable, worldwide license to access, perform and/or display the Artwork and Brand using the NFT, solely for your personal, non-commercial purposes.

Except for the license granted above, Rock&Roll TimeTable, it’s agents and affiliates retain all right, title, and interest in and to the Artwork and Brand.

Furthermore, you may not use the Brand in connection with any product or service that is not Rock&Roll TimeTable’s product or service, or in any manner that is objectionable, likely to cause confusion or dilute, blur, or tarnish the Brand.

All use of the Brand, including any goodwill generated by such use, shall inure to the benefit of Rock&Roll TimeTable.

If you are the recipient or owner of the NFT, you may transfer the NFT to a third party, but, after you do so, your license to the Artwork (including any Brand incorporated therein) will immediately terminate. Your license will also immediately terminate if you breach any of these Terms. Any new recipient of the NFT will be subject to and bound by these Terms.

Jeaster/Rock&Roll TimeTable provides the NFT, and licenses the Artwork to the owner of the NFT, on an “AS IS” basis, and expressly disclaims any warranties or conditions of any kind, either express or implied, including, without limitation, any warranties or conditions of title, non-infringement, merchantability, or fitness for a particular purpose. In no event will Rock&Roll TimeTable or its affiliates be liable for any indirect, incidental, consequential, or other non-direct damages of any kind, even if advised of the possibility of such damages. The maximum aggregate liability of Rock&Roll TimeTable and its affiliates for all damages and causes of action, whether in contract, tort (including negligence) or otherwise, shall be $10.

The laws of the State of New Mexico will govern these Terms and any dispute that arises between you and Rock&Roll TimeTable. All disputes related to these Terms, the NFT or the Artwork will be brought solely in the federal or state courts located in Bernalillo County, New Mexico, USA; and you consent to personal jurisdiction and waive any objection, including to inconvenient forum.

These Terms constitute the entire agreement between you and Rock&Roll TimeTable with respect to the NFT the Artwork and the Brand, and supersedes any prior or contemporaneous written or oral agreements or understandings between you and Rock&Roll TimeTable relating to the NFT, the Artwork, or the Brand.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will likely provide, but at no time are required to, 15 days posting here prior to new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after revisions, you agree to be bound by the revised Terms. If you do not agree to any Terms, stop using the Service and its Artwork.
